§ 1 Service Information

  1. The owner of the Website available at https://sklepstudiofigura.com.pl/pl/ is Izabella Michalak conducting business activity under the name Rollen Polska – Studio Figura Izabella Michalak with its registered office in Lusówek, ul. Wiązowa 56, 62-080, entered into the Central Registration and Information on Business under NIP 7831266218, REGON 300224173, contact details: admin@studiofigura.com.pl.
  2. Through the Website and its subpages, the Website Owner provides electronic services, including the Newsletter service, and enables the User to conclude a contract for the supply of digital content, under which data payments are made. The terms and conditions of the newsletter also apply to all websites or services that contain a reference to it and websites that are launched for the purposes of a specific product, service or event.

§ 2 Definitions

  1. Newsletter Subscription Form – an interactive form available on the Website or another website made available by the Website Owner enabling subscription to the Newsletter service.
  2. Newsletter – a service provided electronically by the Website Owner to the User who has actively subscribed to the list of Subscribers via the Subscription Form available on the Website or on a dedicated page for subscribing to the Newsletter service. As part of the provision of the service, the Materials are provided.
  3. Materials – data generated and delivered in digital form, including in particular information made available in exchange for subscription to the newsletter or data generated or provided in the course of providing the newletter service; digital content within the meaning of Article 2 points 5 of the Consumer Rights Act.
  4. Subscriber – a User who has expressed their willingness to use the Newsletter service and agreed to receive messages via e-mail communication to the e-mail address provided by them.
  5. Payment by data – providing the User’s personal data in exchange for providing the Materials.
  6. Price – a value expressed in monetary units that the User is obliged to pay to the Website Owner for a product, and in relation to a digital product – also a digital representation of the value; price within the meaning of Art. 2 points 5) The Consumer Rights Act.
  7. Newsletter Terms and Conditions – this document.
  8. Website – a website at https://sklepstudiofigura.com.pl/pl/ and all its subpages and websites that are launched for the purposes of a specific product, service, event, etc.
  9. User – any natural person visiting the Website who wants to use the Newsletter service. The website is not intended for children. You must be at least 16 years of age, or if you are under 16 years of age, you must obtain the consent of your legal guardian in order to obtain the Services. The Website Owner is entitled to take action to verify the User’s age.
  10. Order – a declaration of intent of the User, submitted via the Website, another dedicated interface or via e-mail, aimed directly at concluding an agreement on the terms and conditions specified in the Website Terms and Conditions.
  11. Consumer Rights Act – the Act of 30 May 2014 on consumer rights.
  12. Information society service – any service normally provided for remuneration, remotely, electronically and at the individual request of the User.
  13. Act on Providing Services by Electronic Means – the Act of 18 July 2022 on Providing Services by Electronic Means.
  14. Telecommunications Law – the Telecommunications Law Act of 16 July 2004.

§ 3 General terms and conditions of use of the website

  1. The Newsletter Terms and Conditions define the rules for using the Newsletter services, the method of concluding and terminating contracts for the supply of digital content, under which data payment or payment of the price is made, the terms of delivery and the complaint procedure.
  2. The rules for using electronic services other than the Newsletter are regulated in the Terms and Conditions of the Website.
  3. For the purposes of the Newsletter Terms and Conditions, the Website Owner provides their contact details:

  4. The information provided on the Website about the Newsletter service does not constitute an offer within the meaning of the Civil Code, but is only an invitation to conclude an agreement within the meaning of Art. 71 of the Civil Code.
  5. Before starting to use the Website, the Website Owner makes the Newsletter Terms and Conditions available to the User free of charge at the very bottom of the Website and each time next to the Newsletter subscription form. The content of the Newsletter Terms and Conditions may be recorded by the User by downloading, saving on a carrier or printing it at any time from the Website.

§ 4 Technical requirements

  1. The User may use the Newsletter in a manner consistent with the Newsletter Terms and Conditions and applicable law, as well as in a manner that does not interfere with the functioning of the Website and the activities undertaken by other Users.
  2. The use of the Website, including subscribing to the Newsletter service, is possible provided that the User meets the minimum technical requirements:
    1. having a device that allows access to the Internet, equipped with an efficient operating system, e.g. Mac OS, Android, Windows,
    2. installing on the device referred to above, an up-to-date version of a web browser supporting HTML5, providing access to Internet resources such as: Mozilla Firefox, Google Chrome, Safari or another compatible web browser that supports cookies;
    3. having an active e-mail account.
  3. The use of electronic services is associated with the transmission of data via the Internet, which is burdened with the risk characteristic of this network.
  4. In order to ensure security on the Website, the Website Owner takes technical, organisational and legal measures appropriate to the level of security threat, in particular applies measures to prevent, obtain and modify personal data sent via the Internet by unauthorized persons. The Website Owner ensures the security of data transmission transmitted on the Website by using the SSL protocol.

§ 5 Contract for the supply of digital content

  1. The Website Owner enables the User to conclude a contract for the supply of digital content.
  2. The User concludes a contract for the supply of digital content, under which the User is obliged to make a payment with data or pay a price.
  3. The agreement for the provision of digital content in exchange for payment with data is based on the terms set out in this paragraph and § 6 and 7 of the Newsletter Terms and Conditions – Newsletter Service and Agreement for the provision of digital content in exchange for a price.
  4. The contract for the supply of digital content in exchange for a price is based on the terms set out in § 7 of the Newsletter Terms and Conditions – Contract for the supply of digital content in exchange for a price.

§ 6 Newsletter service

The Website Owner reserves the right to discontinue the provision of Newsletter services at any time. The Website Owner will inform the User about the discontinuation of the Newsletter service via the e-mail address provided as part of the procedure of subscribing to the Newsletter service.

§ 7 Contract for the supply of digital content in exchange for a price

  1. A user who does not want to conclude a contract for the supply of digital content under which data payment is made has the option of concluding a contract for the supply of digital content, under which he will be obliged to pay the price.
  2. The User purchases the Materials in exchange for a price by placing an Order.
  3. In order to place an Order, it is necessary for the User to provide the data necessary to complete the Order, i.e.: 1) name, 2) surname, 3) street, 4) postal code, 5) the city, 6) e-mail address, and in the case of an entrepreneur to whom the provisions of the Act on Consumer Rights apply, additionally: 7) the name of the company and the NIP number.
  4. In response to the placed Order, the Website Owner will present the terms and conditions of sale or provide a dedicated interface to finalize the Order.

§ 8 Complaint procedure

  1. In the event of objections to the Newsletter service or the operation of the Website, the User may file a complaint:
    1. in paper form to the postal address: ul. Skórzewska 26, 62-081, Wysogotowo.
    2. in electronic form to the following e-mail address: admin@studiofigura.com.pl.
  2. The complaint should contain data enabling the identification of the User, the subject of the complaint and the demands related to the complaint. It is recommended to provide information and circumstances regarding the subject of the complaint in the complaint description, in particular the type and date of the irregularity, as well as the specification of the request and contact details of the person submitting the complaint.
  3. Any complaints are resolved immediately, no later than within 30 calendar days from the date of filing the complaint. The complainant receives a response in the same form in which the complaint was submitted, unless the User indicates otherwise.

§ 9 Personal data and cookies

Detailed information on the principles of personal data processing, including information on the User’s rights related to the processing of personal data, as well as the rules for the use of cookies and other technologies can be found in the Privacy Policy.

§ 10 Changes to the newsletter terms and conditions

  1. The Website Owner reserves, to the extent permitted by applicable regulations, the right to amend the Newsletter Terms and Conditions.
  2. The Website Owner is entitled to unilaterally amend the Newsletter Terms and Conditions to the extent that has not been individually agreed with the User for justified reasons. In particular, the following are considered to be justified causes:
    1. an amendment to the generally applicable law in the Republic of Poland to the extent that such a change in the regulations modifies the content of the Newsletter Terms and Conditions or imposes on the Website Owner the obligation to modify the Newsletter Terms and Conditions in a specific way,
    2. The Terms and Conditions require supplementation, clarification or modification due to the provisions of law generally applicable in the Republic of Poland or due to the need to create greater transparency of the Newsletter Terms and Conditions – to the extent that supplementing, clarifying or modifying the Newsletter Terms and Conditions is permissible by law or due to the need to increase the transparency of the Newsletter Terms and Conditions,
    3. issuance by public administration bodies of decisions, recommendations, or acts of a similar nature as documents modify the content of the Newsletter Terms and Conditions or impose on the Website Owner the obligation to modify the Newsletter Terms and Conditions in a specific way,
    4. introduction by the Website Owner of the Website functionalities or modification of their existing scope – to the extent that the new functionalities modify the content of the Newsletter Terms and Conditions,
    5. introduction of new or modification of existing IT systems by the Website Owner – to the extent that they affect the content of the Newsletter Terms and Conditions, and the modification of the Newsletter Terms and Conditions is objectively necessary and directly related to the introduction of new or modification of existing IT systems,
    6. the emergence of court or administrative rulings which show that the content of the Newsletter Terms and Conditions is contrary to the law – to the extent that from the point of view of an average Consumer or Entrepreneur with consumer rights, the proposed amendment to the Newsletter Terms and Conditions is in their favour.
  3. The amendment to the Newsletter Terms and Conditions does not apply to agreements concluded before the effective date of the amendment to the Newsletter Terms and Conditions. Agreements concluded before the date of entry into force of the amendment to the Newsletter Terms and Conditions shall be subject to the provisions of the Terms and Conditions in force on the date of expressing the User’s will to conclude the agreement.
  4. The Website Owner informs the User about the proposed amendment to the Newsletter Terms and Conditions by publishing on the Website the content of the proposed amendment to the Newsletter Terms and Conditions, the date of entry into force of the amendments to the Newsletter Terms and Conditions and the uniform content of the Newsletter Terms and Conditions after the amendments.
  5. In the case of the Newsletter service, the Website Owner will inform the User about the content of the proposed amendment to the Newsletter Terms and Conditions, the effective date of the amendments to the Newsletter Terms and Conditions and the uniform content of the Newsletter Terms and Conditions after the changes via e-mail provided as part of the procedure for subscribing to the Newsletter service.
  6. Before the amendments to the Newsletter Terms and Conditions come into force, the User may declare to the Website Owner that they do not accept the changes introduced. A statement of disagreement with the amendment of the Terms and Conditions is tantamount to the User’s resignation from the Newsletter services.
  7. In the case of continuous contracts (e.g. Newsletter services), changes made to the Newsletter Terms and Conditions apply to the User if the User has been properly notified of the changes and has not terminated the concluded Agreement within 14 days from the date of receipt of the notification of the change.

§ 11 Final provisions

  1. Contracts are concluded in Polish and based on the provisions of Polish law.
  2. For the avoidance of doubt, it is assumed that none of the provisions of the Newsletter Terms and Conditions to which the provisions of the Act on Consumer Rights apply, to which the consumer is entitled under the provisions of the law in force in the territory of the Republic of Poland. If it is found that there is a provision of the Newsletter Terms and Conditions of such a nature, the provisions of the applicable law shall apply.
  3. In matters not covered by the Newsletter Terms and Conditions, the applicable provisions of Polish law shall apply.
  4. The Terms and Conditions come into force on July 27, 2023.
